YARD HUSTLE

1. Overview

Yard Hustle ("App"), owned by KM2 LLC ("we," "us," "our"), is a platform that connects local customers ("Customers") with minors performing yard work ("Hustlers"), under the supervision and full responsibility of a parent or legal guardian ("Parent/Guardian").

By using Yard Hustle, all Users agree to these Terms.

2. Platform-Only; No Employment Relationship

KM2 LLC is not an employer and does not hire, supervise, train, or direct any Hustler. Hustlers act as independent contractors, supervised solely by their Parent/Guardian.

KM2 LLC does not:

Provide equipment
Set prices
Control scheduling
Supervise work
Guarantee results
Provide transportation
Provide insurance

All agreements for yard work are strictly between the Parent/Guardian, Hustler, and Customer.

3. Parental Responsibility and Supervision

Parents/Guardians are entirely responsible for:

The safety, conduct, and supervision of their Hustler
Ensuring weather-appropriate conditions
Reviewing job requests
Monitoring location and check-ins
Providing training and safety instruction
Appropriateness of tasks
Ensuring lawful equipment use

Parents/Guardians acknowledge they are solely responsible for any injury, damages, disputes, or misconduct.

4. Assumption of Risk

Yard work involves inherent physical risks, including:

Equipment injury
Heat exposure
Cuts or abrasions
Interaction with strangers
Uneven terrain
Weather-related dangers
Physical exertion

By using the App, all Users — including Parents/Guardians — voluntarily assume all risk associated with yard work, job acceptance, travel, and on-site performance.

KM2 LLC is not liable for injuries, property damage, loss, or disputes between Users.

5. Payments and Financial Responsibility

Yard Hustle processes payments through Stripe, Inc. ("Stripe"), a third-party payment processor. By using the App, you agree to Stripe's Terms of Service and Privacy Policy.

Payment Processing:

Customers must add a valid payment method before booking jobs
Payment methods are stored securely by Stripe
When a job is accepted, payment is authorized and held in escrow
Funds are released to the Hustler after customer confirms job completion
If customer does not confirm within 24 hours, funds automatically release

Platform Fees:

KM2 LLC charges customers a 5% Yard Hustle service fee on jobs booked through the app
Yard Hustle Pro partners pay an additional 10% Pro partner fee from their Pro Direct payout
Yard Hustle Pro does not require a monthly subscription unless a separate paid plan is offered and accepted later
Customers see the job price and service fee before paying
Regular Hustler payouts are based on the agreed job price; Pro Direct payouts are reduced by the Pro partner fee
Platform fees are non-refundable except in cases of platform error

Refunds and Disputes:

Refunds may be issued at KM2 LLC's discretion for incomplete or unsatisfactory work
Disputes must be reported within 24 hours of job completion
KM2 LLC reserves the right to hold funds during dispute resolution

6. Safety Requirements

Hustlers must:

Follow all safety rules outlined in the App
Wear appropriate clothing
Use equipment only with Parent/Guardian approval
Take breaks in heat
Never enter a Customer's home
Avoid unsafe areas
Decline any job that feels unsafe

Customers agree to provide a safe, accessible work area.

7. Verification and Background Checks

KM2 LLC does not perform criminal background checks, safety certifications verification, or comprehensive identity verification. All interactions are at the User's own risk.

Yard Hustle offers optional verification options for customers: ID Verification, Full Verification (ID + Background Check), and Parent-Trusted (community vouching). Verification is optional and does not guarantee customer safety.

8. Yard Hustle Pro Users and Approved Companies

Yard Hustle Pro is a reviewed access path for approved companies, organizations, or adult service providers ("Pro Users") that may receive eligible customer jobs or offer supervised youth opportunities through the App. Approval for Yard Hustle Pro is a privilege, not a right, and may be denied, paused, suspended, or revoked at any time.

Pro Users agree that they are solely responsible for:

Maintaining all licenses, permits, insurance, tax registrations, vehicle coverage, and business authorizations required for their services
Ensuring every worker, supervisor, employee, contractor, volunteer, or representative they involve is legally allowed, properly trained, and safely supervised
Providing accurate company, contact, service-area, insurance, supervision, youth-safety, and opportunity information
Accepting only jobs they can complete safely, lawfully, professionally, and within the agreed scope, schedule, and price
Keeping all job scheduling, payment, support, and dispute communications inside Yard Hustle unless KM2 LLC expressly approves otherwise
Complying with all applicable labor, child-safety, wage, tax, consumer-protection, privacy, background-check, transportation, and insurance laws

Pro Users are independent businesses or service providers. They are not employees, agents, franchisees, partners, or representatives of KM2 LLC. KM2 LLC does not supervise Pro Users, direct how Pro work is performed, guarantee Pro availability, guarantee job volume, guarantee earnings, or guarantee customer demand.

Pro Direct and other Pro routing options are customer choice and platform routing features. They do not guarantee that a Pro User will receive, claim, retain, or be paid for any job. Customers may choose youth-first routing, Pro Direct, either option, or another available path when supported by the App.

If a Pro opportunity involves a minor, youth participant, student, family member, or Yard Hustler, the Pro User and the Parent/Guardian remain fully responsible for supervision, safety, transportation, equipment use, working conditions, age-appropriate tasks, consent, and compliance with all applicable laws. Yard Hustle Pro does not reduce or replace Parent/Guardian responsibility.

KM2 LLC may remove Pro access, pause job routing, withhold or reverse funds as allowed by these Terms and payment-processor rules, investigate reports, require updated documentation, or remove any Pro User or Pro opportunity that creates safety, trust, legal, payment, customer-service, or brand risk.

Pro Users agree to indemnify, defend, and hold harmless KM2 LLC from claims, injuries, damages, losses, penalties, taxes, disputes, chargebacks, worker claims, customer claims, youth-safety claims, and regulatory matters arising from their services, personnel, supervision, business operations, or use of Yard Hustle Pro.

9. User Conduct

Users agree not to:

Harass others
Submit false information
Damage property
Use the App for unlawful purposes
Circumvent safety features
Share phone numbers, email addresses, links, social handles, or other off-platform contact information to coordinate jobs outside Yard Hustle
Move job scheduling, payment, support, or dispute communications outside Yard Hustle

For safety reasons, job-related communication should stay inside Yard Hustle so scheduling, payment, support, and dispute context remains available in the App.

KM2 LLC may suspend or remove accounts violating these Terms.

10. Data Use, Communications, and Location

Yard Hustle may contact Users by email, phone, SMS/text message, in-app message, or other contact method provided to the App for transactional, operational, safety, support, scheduling, payment, dispute, cancellation, or account-related purposes.

These communications may relate to active or pending job requests, bookings, Customer or Hustler availability, safety concerns, payment issues, cancellations, dispute resolution, or platform support. Marketing communications, if any, are separate and subject to applicable consent and opt-out requirements.

Yard Hustle SMS/text messages may include account notices, job request updates, booking and schedule reminders, safety or support messages, payment or dispute updates, review requests, and optional promotional updates only when a User has separately opted in to marketing texts. Message frequency varies based on account and job activity. Message and data rates may apply. Reply STOP to opt out of SMS messages and HELP for help, or contact support@yardhustleapp.com. Carriers are not liable for delayed or undelivered messages.

The App uses ZIP code information for job matching purposes. We do NOT track real-time location of minors.

11. Insurance Disclaimer

KM2 LLC does not provide liability insurance, accident coverage, property protection, or workers' compensation. Users must handle their own insurance needs.

12. Dispute Resolution; Binding Arbitration

Any dispute shall be resolved exclusively through binding arbitration in the State of Florida.

Users waive the right to bring lawsuits in court, participate in class actions, and seek jury trials.

13. Indemnification

Users agree to indemnify, defend, and hold harmless KM2 LLC from any claim, injury, dispute, or loss resulting from user actions, negligence, job performance, property damage, misconduct, misuse of the App, or Yard Hustle Pro services, opportunities, personnel, supervision, or business operations.

14. Modification of Terms

KM2 LLC may update these Terms at any time upon posting. Continued use of the App after changes become effective means you accept the revised Terms.
