1. Overview

Yard Hustle ("App"), owned by KM2 LLC ("we," "us," "our"), is a platform that connects local customers ("Customers") with minors performing yard work ("Hustlers"), under the supervision and full responsibility of a parent or legal guardian ("Parent/Guardian").

By using Yard Hustle, all Users agree to these Terms.

2. Platform-Only; No Employment Relationship

KM2 LLC is not an employer and does not hire, supervise, train, or direct any Hustler. Hustlers act as independent contractors, supervised solely by their Parent/Guardian.

KM2 LLC does not:

  • Provide equipment
  • Set prices
  • Control scheduling
  • Supervise work
  • Guarantee results
  • Provide transportation
  • Provide insurance

All agreements for yard work are strictly between the Parent/Guardian, Hustler, and Customer.

3. Parental Responsibility and Supervision

Parents/Guardians are entirely responsible for:

  • The safety, conduct, and supervision of their Hustler
  • Ensuring weather-appropriate conditions
  • Reviewing job requests
  • Monitoring location and check-ins
  • Providing training and safety instruction
  • Appropriateness of tasks
  • Ensuring lawful equipment use

Parents/Guardians acknowledge they are solely responsible for any injury, damages, disputes, or misconduct.

4. Assumption of Risk

Yard work involves inherent physical risks, including:

  • Equipment injury
  • Heat exposure
  • Cuts or abrasions
  • Interaction with strangers
  • Uneven terrain
  • Weather-related dangers
  • Physical exertion

By using the App, all Users — including Parents/Guardians — voluntarily assume all risk associated with yard work, job acceptance, travel, and on-site performance.

KM2 LLC is not liable for injuries, property damage, loss, or disputes between Users.

5. Payments and Financial Responsibility

Yard Hustle processes payments through Stripe, Inc. ("Stripe"), a third-party payment processor. By using the App, you agree to Stripe's Terms of Service and Privacy Policy.

Payment Processing:

  • Customers must add a valid payment method before booking jobs
  • Payment methods are stored securely by Stripe
  • When a job is accepted, payment is authorized and held in escrow
  • Funds are released to the Hustler after customer confirms job completion
  • If customer does not confirm within 24 hours, funds automatically release

Platform Fees:

  • KM2 LLC charges a 5% platform fee on each completed job
  • Platform fee is deducted from the job price before payout
  • Customers pay the full agreed price; the platform fee is included
  • Platform fees are non-refundable except in cases of platform error

Refunds and Disputes:

  • Refunds may be issued at KM2 LLC's discretion for incomplete or unsatisfactory work
  • Disputes must be reported within 24 hours of job completion
  • KM2 LLC reserves the right to hold funds during dispute resolution

6. Safety Requirements

Hustlers must:

  • Follow all safety rules outlined in the App
  • Wear appropriate clothing
  • Use equipment only with Parent/Guardian approval
  • Take breaks in heat
  • Never enter a Customer's home
  • Avoid unsafe areas
  • Decline any job that feels unsafe

Customers agree to provide a safe, accessible work area.

7. Verification and Background Checks

KM2 LLC does not perform criminal background checks, safety certifications verification, or comprehensive identity verification. All interactions are at the User's own risk.

Yard Hustle offers optional verification options for customers: ID Verification, Full Verification (ID + Background Check), and Parent-Trusted (community vouching). Verification is optional and does not guarantee customer safety.

8. User Conduct

Users agree not to:

  • Harass others
  • Submit false information
  • Damage property
  • Use the App for unlawful purposes
  • Circumvent safety features

KM2 LLC may suspend or remove accounts violating these Terms.

9. Data Use and Location

The App uses ZIP code information for job matching purposes. We do NOT track real-time location of minors.

10. Insurance Disclaimer

KM2 LLC does not provide liability insurance, accident coverage, property protection, or workers' compensation. Users must handle their own insurance needs.

11. Dispute Resolution; Binding Arbitration

Any dispute shall be resolved exclusively through binding arbitration in the State of Florida.

Users waive the right to bring lawsuits in court, participate in class actions, and seek jury trials.

12. Indemnification

Users agree to indemnify, defend, and hold harmless KM2 LLC from any claim, injury, dispute, or loss resulting from user actions, negligence, job performance, property damage, misconduct, or misuse of the App.

13. Modification of Terms

KM2 LLC may update these Terms at any time upon posting. Continued use of the App after changes become effective means you accept the revised Terms.
